Language Boosters – Terms of Use

Language Boosters is included free of charge with Primary Languages Network membership. These terms explain how member schools, their staff and their pupils may use it.

1. About these terms

  1. Language Boosters is an online language learning app provided by Primary Languages Network Group Ltd (company number 12118977), Abney Hall, Manchester Road, Cheadle, SK8 2PD (PLN, we, us).
  2. Language Boosters is an add-on to Primary Languages Network membership. There is no extra charge for it.
  3. These terms apply alongside the school's membership terms with PLN (the Membership Terms). If they conflict on anything about Language Boosters, these terms apply.
  4. School or you means the member school. The person who registers the school for Language Boosters confirms that they are authorised to accept these terms on the school's behalf.
  5. Our Language Boosters Privacy Notice and the data processing agreement between the school and PLN (see clause 6) also form part of these terms.

2. Who can use Language Boosters

  1. Language Boosters may be used only by a member school, its authorised staff and its pupils, and only while the school's membership is active.
  2. Access is for the school's own educational use. The school may not resell it, share it with other schools or let anyone outside the school use it.

3. Accounts and logins

  1. The school's admin sets up and manages staff and pupil accounts.
  2. We recommend randomly generated pupil usernames and a shared class password. This avoids using pupils' real names and keeps logins simple for young children. Entering real names is optional.
  3. The school is responsible for:
    1. keeping staff and pupil login details secure;
    2. sharing pupil logins and QR codes securely, in line with its own safeguarding policy;
    3. removing accounts for staff and pupils who leave; and
    4. everything done under its accounts.
  4. Please tell us straight away at sylvia@primarylanguages.network if you think a login has been misused or shared with someone who should not have it.

4. Acceptable use

The school, its staff and pupils must not:

  1. enter special category data (for example, information about health, ethnicity or religion) or any personal data that Language Boosters does not ask for;
  2. copy, download, reproduce or share Language Boosters content outside the app, except as the app allows;
  3. try to access other schools' accounts or data, or get around the app's security;
  4. copy, reverse engineer or interfere with the app or its servers; or
  5. use Language Boosters for anything unlawful or harmful.

5. Content and intellectual property

  1. PLN and its licensors own all rights in Language Boosters, including its games, audio, images, text and software.
  2. While the school's membership is active, PLN gives the school a non-exclusive, non-transferable licence to use Language Boosters with its staff and pupils for teaching and learning.
  3. Pupil progress data belongs to the school.

6. Data protection

  1. For pupil and staff account data in Language Boosters, the school is the data controller and PLN is the data processor.
  2. PLN processes that data only to provide Language Boosters and only on the school's instructions, under a data processing agreement between the school and PLN. We can provide our standard Data Processing Agreement, or review and sign the school's own.
  3. Language Boosters is hosted by My Learning UK Ltd on servers in Germany. Full details are in the Language Boosters Privacy Notice.
  4. The school is responsible for telling pupils and parents how their data is used, for example in its own privacy notice.

7. Safeguarding

  1. Language Boosters does not show adverts, and PLN never contacts pupils directly.
  2. The school remains responsible for supervising pupils' use of technology, at school and when it sets home learning, in line with its safeguarding and online safety policies.

8. Availability and changes

  1. We aim to keep Language Boosters available at all times. It may sometimes be unavailable for maintenance, updates or reasons outside our control. Where we can, we will give notice of planned downtime.
  2. We may add, change or remove content and features to improve Language Boosters. We will not make changes that significantly reduce its overall value to members without telling schools first.
  3. We may stop offering Language Boosters as part of membership by giving member schools at least 3 months' notice by email. Because Language Boosters is a free add-on, this will not change the membership fee. We will give schools the chance to export pupil progress data before access ends.

9. Suspending access

We may suspend an account, or a school's access, if we reasonably believe that:

  1. a login has been misused or shared with someone outside the school;
  2. these terms have been seriously breached; or
  3. suspension is needed to protect the security of Language Boosters or other schools' data.

We will tell the school why, and restore access as soon as the issue is resolved.

10. When access ends

  1. The school can stop using Language Boosters at any time, and can delete pupil and staff accounts itself.
  2. Access to Language Boosters ends automatically when the school's Primary Languages Network membership ends.
  3. When membership ends, all of the school's pupil and staff data in Language Boosters is permanently deleted straight away.
  4. Deleted data is removed from backups as they are overwritten, and it is not used in the meantime.

Please note: schools should export any pupil progress records they want to keep before their membership ends.

11. Liability

  1. Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited or excluded by law.
  2. Subject to clause 11.1, PLN is not liable for:
    1. indirect or consequential loss;
    2. loss caused by the school not following clause 3 (for example, login details shared insecurely or set up in a way that identifies pupils, against our recommendations); or
    3. Language Boosters being temporarily unavailable.
  3. Subject to clause 11.1, PLN's total liability for Language Boosters in any membership year is limited to the membership fees the school paid in that year.
  4. This clause does not affect either party's obligations under the Data Processing Agreement or data protection law.

12. Changes to these terms

We may update these terms from time to time. We will email member schools at least 30 days before any significant change takes effect. If the school continues to use Language Boosters after that, the updated terms apply.

13. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
